Trees on Your Own Home Lot
In many cities, a homeowner can remove a tree on their own residential lot without a permit. Durham's rules are written for development more than for ordinary yards, but details change, and some neighborhoods have extra rules. Check before work starts.
Street Trees and Public Land
A tree in the road right-of-way or on public land is not yours to cut. The city, county or state owns it. Call them and do not hire a crew to remove it.
New Construction and Lot Clearing
Tree protection and canopy rules in the city and county development ordinance can apply when you are building, adding on or clearing a lot. A plan may be needed. Ask the planning office or your builder.
HOAs and Neighborhoods
Some HOAs and historic neighborhoods require approval before removal. Check your covenants.
How to Check
- Call the city or county planning office with your address
- Read your HOA rules
- Ask the tree service, since good crews know the local rules
